How to Rebalance the Scales of Justice in Trucking and Avoid a Nuclear Verdict
A jackpot justice system has caused nuclear verdicts against trucking companies to escalate. In fact, nuclear verdicts—those verdicts over $10 million—against trucking companies have skyrocketed 967% in the last 15 years, according to research from the American Transportation Research Institute. “That is pretty frightening. These verdicts outpace increases in health care costs and inflation,” said Paul Enos, CEO of the Nevada Trucking Association during the PrePass webinar “Rebalancing the Scales of Justice with Tactical Training in Trucking Litigation Defense.”

The Federal Motor Carrier Safety Administration has granted a petition from the Commercial Vehicle Safety Alliance to consider requiring all interstate commercial motor vehicles to have devices installed that electronically transmit driver, carrier, and truck data. These “universal identification devices” would allow roadside enforcement to identify and perhaps even monitor the condition of drivers and CMVs on the highway. FMCSA seeks approval through an Information Collection Request, to continue requiring motor carriers who lease or interchange equipment with others to maintain a written lease. That lease should describe the equipment and specify the start and end time and date of the transfer. FMCSA rules also mandate that the acquiring carrier identify/mark the equipment as being in its service.

In late September, the USDOT convened a meeting of the National Coalition of Truck Parking and unveiled a “Truck Parking Development Handbook,” designed to help states plan and build new truck parking capacity. Of equal importance to states willing to tackle the truck parking shortage was a USDOT memorandum describing in detail the funding categories where truck parking is an eligible expenditure and how states can access those funds.
